Creating or Reviewing Your Will With Your Goals in Mind
Without a will, neither your family nor the courts have any way of knowing for sure how you want your estate to be distributed. There are many circumstances in which you may want to consider creating a will or reviewing your existing will, including the following:
- Getting married
- Purchasing a home
- Having children
- Getting divorced or separated
- Undergoing a major medical procedure
- Entering a nursing home
Even in the absence of any of these circumstances, we recommend that you have a lawyer review your existing will on a regular basis. If you have recently moved into Ontario — especially from Quebec — we also strongly encourage you to have your will reviewed.
One major issue to consider when creating a will is probate fees. These are essentially a tax that is placed on your estate when it goes through administration. A properly drafted estate plan can often reduce probate fees through the use of secondary wills and other mechanisms.
